Please read these Terms of Service ("Terms") carefully before using Daily Markdown ("the app", "our app") operated by Valters Grisans ("we", "us", or "our").
Acceptance of Terms
By downloading, installing, or using Daily Markdown, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the app.
Description of Service
Daily Markdown is a personal journaling application for macOS that allows you to:
- Create and edit daily notes using Markdown formatting
- Sync notes across devices via iCloud
- Track writing streaks and habits
- Customize the app appearance
License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the app for your personal, non-commercial purposes.
Restrictions
You agree not to:
- Copy, modify, or distribute the app
- Reverse engineer, decompile, or disassemble the app
- Remove or alter any proprietary notices
- Use the app for any unlawful purpose
- Attempt to gain unauthorized access to any systems or networks
Your Content
You retain full ownership of all notes and content you create using Daily Markdown. We do not claim any rights to your content. You are solely responsible for the content you create and store using the app.
Data and Privacy
Your use of the app is also governed by our Privacy Policy. By using Daily Markdown, you acknowledge that:
- All data is stored locally on your device or in your personal iCloud account
- We do not have access to your notes or personal information
- You are responsible for backing up your data
iCloud Services
If you choose to use iCloud sync, your data will be subject to Apple's terms and conditions. We are not responsible for any issues arising from iCloud services, including but not limited to data loss, sync failures, or service interruptions.
Updates
We may release updates to the app from time to time. These updates may include bug fixes, new features, or security improvements. We recommend keeping the app updated to the latest version.
Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The app will meet your specific requirements
- The app will be uninterrupted, timely, secure, or error-free
- Any errors in the app will be corrected
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
- Your use or inability to use the app
- Any unauthorized access to or use of your data
- Any bugs, viruses, or other harmful code
- Any content or conduct of any third party
Indemnification
You agree to indemnify and hold harmless Valters Grisans from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the app or violation of these Terms.
Termination
We reserve the right to terminate or suspend your access to the app at any time, without prior notice, for any reason, including breach of these Terms. Upon termination, your license to use the app will immediately cease.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of any material changes by updating the "Last updated" date. Your continued use of the app after such changes constitutes acceptance of the new Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of Latvia, without regard to its conflict of law provisions.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
